Women jailed after separate incidents at local restaurants

The following felony arrests were among those reported by officers of the Atmore Police Department during the period December 6-13:
Shivoyer English
The 43-year-old McDavid, Fla. woman was arrested December 7 on a felony drug possession charge after police responded to the McDonald’s on South Main Street, where she was reportedly throwing food at vehicles.
Police reports show the incident, which began as a disorderly conduct complaint, occurred around 11:10 a.m. when police contacted the food-tosser, who “was agitated and was yelling and cursing.”
Officers were unable to calm the woman down, so they placed her under arrest for disorderly conduct and took her to Atmore Municipal Jail. During the booking process, officers discovered more than 20 grams of synthetic cannabis (Spice) and various drug-related items on her person.
English was charged locally with disorderly conduct, then processed into the Escambia County Detention Center (ECDC) on one count each of possession of a controlled substance, second-degree promoting prison contraband, and possession of drug paraphernalia.
She remained in the county jail Monday afternoon, December 16.
Kimberly Foster
Police arrested the 39-year-old Atmore woman after officers were dispatched to Jalisco’s on Lindberg Avenue, where reports were that the woman was obviously intoxicated and was “screaming at customers and exposing her breasts.”
Police, who arrived around 2:40 p.m., learned on the way to the restaurant that the woman had also stolen a debit card from another customer. Officers made contact with the unruly diner and confirmed she was indeed exposing herself and “appeared to be extremely intoxicated.”
When an officer ordered Foster to come to him, she instead took off running. She was caught and cuffed after a foot pursuit and brief struggle and booked into the county jail.
She remained in the facility Monday, December 16, charged with one count each of third-degree robbery, third-degree theft of property, resisting arrest, public lewdness and public intoxication.
Rodney Showers
The Walnut Hill, Fla. man was arrested December 8 on a felony drug possession charge after crack cocaine was found on his person while he was being arrested on a misdemeanor shoplifting charge.
According to police reports, officers were on an unrelated call to Walmart on North Main Street when, around 5:25 p.m., the store’s loss prevention personnel observed Showers shoplifting, and APD officers assisted them with recovering the stolen merchandise.
A pre-arrest search of the suspect turned up “a small amount of crack cocaine, and a glass pipe with crack cocaine residue.
Showers was booked into the ECDC on one count each of possession of a controlled substance, possession of drug paraphernalia, and fourth-degree theft of property. He is no longer listed on the jail roster.
Joseph Hayles
A 28-year-old Bay Minette man was arrested December 6 on felony drug possession charges after police responded to Walmart, where they had received a report of a “possible drunk driver” in the store’s parking lot.
The incident occurred around 7:30 a.m., and one of the responding officers observed the vehicle that had been described by the caller as it left Walmart and turned onto North Main Street.
According to reports, the officer followed the vehicle “to observe the driving pattern” and noted the driver did not seem to be under the influence. However, the vehicle’s license plate had been expired for three years, and it was pulled over.
The driver, later identified as Hayles, “stepped out of the vehicle and the officer observed a small plastic baggie containing over two grams of a substance that field-tested positive for methamphetamine.” The officer also recovered a used hypodermic needle that contained meth residue.
Hayles was placed under arrest and charged with possession of a controlled substance and possession of drug paraphernalia. He was booked into the county jail but has since been released.
Makhail Reynolds
Note: The basics of this arrest (name, charges, etc.) were posted in last week’s newspaper, but most of the details had not been released at that time.
The Atmore man, fingered as the assailant in a December 8 domestic violence incident, was also charged with felony drug possession after more than 5 grams of synthetic cannabis (Spice) and more than 5 grams of a substance that field-tested positive for cocaine were found on his person during a pre-arrest pat-down.
According to police reports, officers were sent to an undisclosed location around 5:50 a.m. after a complainant requested a welfare check on a family member who was involved in what was a “possible domestic violence incident.”
The victim, who had suffered visible injuries, told police that Reynolds, 37, had administered her injuries and was still in the area.
Officers located and detained Reynolds on the domestic complaint, and during a search of his person they discovered he was in possession of the illegal substances, as well as “items used to ingest drugs.”
Reynolds is charged with one count each of domestic violence by strangulation or suffocation, possession of a controlled substance, unlawful distribution of a controlled substance, and possession of drug paraphernalia. Jail records show he was released on December 11.
Abel Boggan
The 64-year-old Atmore man was arrested December 12 after police were sent around 1:30 p.m. to a local business, where a sexual assault had reportedly taken place.
Officials of the business told police one of their employees had been sexually assaulted by a customer, and the victim reportedly pointed out her assailant to police. APD investigators were able to identify the man as Boggan, an arrest warrant was obtained, and he was taken into custody a short time later.
Boggan is charged with one count of first-degree sexual abuse. He was no longer listed on the jail roster by Monday, December 16, and no mug shot was available.
According to Alabama law, a person commits the crime of sexual abuse (a Class C felony) in the first degree if he or she subjects another person who is incapable of consent by reason of being physically helpless or mentally incapacitated, to sexual contact. Sexual contact is defined as the intentional touching of the sexual or other intimate parts of a person.
